# Selling subscriptions? Make renewals and cancelling follow the law.

28 states and D.C. have auto-renewal laws, and the federal "click to cancel" rule was struck down in July 2025, so the states are where the lawsuits are. We go through your sign-up, checkout, confirmation email and cancel flow, and tell you exactly what to change. Confusing renewals also cause "subscription cancelled" chargebacks, so the same fix helps twice.

- Shopify subscription apps (Recharge, Skio, Loop, Appstle, Bold, Seal), WooCommerce Subscriptions, Stripe Billing, Paddle, membership sites
- Written report in 5 business days, $299
- Exact wording, checkbox and button changes, state by state

## What the laws ask for

The details differ by state, but most auto-renewal laws ask for the same things ([Legal500](https://www.legal500.com/intelligence/united-states/consumer-protection/the-coming-state-law-litigation-wave-of-2026-27-subscription-trap-class-actions)):

- **Clear terms before payment:** the price, how often it's charged, that it continues until cancelled, and how to cancel, shown near the pay button.
- **A separate yes** to the renewal terms, recorded.
- **A confirmation** the customer can keep, with the terms and how to cancel.
- **Online cancellation** at least as easy as signing up.
- **Reminders** before some renewals, and notice before a price goes up.

| State | Notable rules | Why it matters |
| --- | --- | --- |
| California | Since 1 July 2025: "express affirmative consent" to the renewal terms (a separate checkbox is safest), a yearly reminder for annual plans, notice 7 to 30 days before a price change, and a prominent "cancel" button next to any save offer ([Arnold & Porter](https://www.arnoldporter.com/en/perspectives/advisories/2025/01/new-california-requirements-for-subscriptions-in-2025)) | Anything billed without following the law counts as an "unconditional gift", so the customer can claim the money back |
| Illinois | A written reminder 30 to 60 days before the cancel deadline for terms of 12 months or more; written procedures for getting consent | Claims go under the Consumer Fraud Act, with lawyers' fees, which drives repeat suits |
| Virginia | 2026 changes: cancel through the same channel you signed up in; phone cancelling must be free | Up to $5,000 per violation, and small businesses buying subscriptions are protected too |
| 25 other states and D.C. | Similar disclosure, consent and cancel rules | At least 17 jurisdictions allow class claims |

The federal ROSCA law still applies to online subscriptions everywhere in the US.

## What we check

We sign up and cancel on your site the way a customer would (with a test order or a test account you give us).

- **Product and plan pages:** is the renewal price, frequency and cancel information next to the button?
- **Checkout:** is there a separate yes to the renewal terms, and is it recorded?
- **Confirmation email:** does it repeat the terms and say how to cancel?
- **Account and cancel flow:** can a customer cancel online, quickly, with the cancel button next to any save offer?
- **Reminders and price changes:** are annual reminders and price-change emails set up in your subscription app?
- **Report:** screenshots, what each state asks for, and the exact wording and settings to change.

## Questions

### Will this stop me being sued?

Nobody can promise that. We show you where your flow differs from what the laws ask for and help you change it. Your lawyer decides what your business must do.

### We use Recharge (or Skio, Loop...). Isn't the app compliant already?

Apps give you the tools, but the wording on your pages, the checkbox, your emails and your cancel settings are yours to set. Those are where most problems are.

### Do you need access to my store?

For the audit, no: a test order or test account is enough. For the fix, we need access to your theme and subscription app, which you can remove any time.

### Who does the work?

DisputeKit, run by Shubhankar Sharma in India. We use automated tools and AI to work faster, and every finding and fix is checked before you see it. We're not lawyers and don't give legal advice; your lawyer decides what the law requires for your business.
